spotting at MCAS Miramar

Have been looking into the very same thing. It seems (!) that walking in the area of https://goo.gl/maps/poF8DqCLP9K2 is possible. Although, that was for people with a dog and without long lenses or giant binoculars...

Just heard, that the local sheriff is very fast with penalties.

Was there last year. Stood in the approach end at Kearny Villa rd between some bushes (somewhat out of sight) for nearly two hours without a hitch. Parked the car at Kearny Mesa rd and walked over.

However when I left I looked through my big lens at the parked up C-130's while there seemed to be a shift change due to increased traffic. They called me in and was soon after stopped by federal police. Long story short they got my details and deleted pictures as they informed me its federal property (Kearny Villa rd that is). I disagree as the San Diego GIS survey states its public property and from public you can take pictures, shoot video of everything you can see. In addition from a public accessibly road the public easement is 30 ft. So on both sides of Kearny Villa rd you should be OK. It is a dual carriage way with bike lanes on either side.

Of my encounter the last thing has not been said. I have reached out the MCAS Miramar and await their response. The Marines though sure are eager to shoot at someone but not so fast with FOIA's. That is unacceptable.

In addition I suggest you google the "2010 DHS memo on public photography." There is a redacted version floating around on the web and it describes what law enforcement can and cannot do when in public and their encounters with photographers. So it is my opinion you can be at Kearny Villa rd but you will most likely get a visit from the authorities. Also please be aware that you do not require to present ID unless you have committed a crime. Which is the second issue I have with the MCAS Miramar folks. If you are indeed on federal property they can only trespass you and for it there are specific requirements as well.
1. They have to ask you to leave.
2. If you refuse they can issue a warning or a citation for which you have to ID yourself.
3. If you stay you will be arrested.

So even in this case you do not require to ID yourself for item 1. Just pack up your stuff and leave. Yes, I know. I was intimidated as well and handed over my ID. Just because I was outnumbered and the guy that did all the talking was a complete douchebag. The other was rather nice.
