WTO Says It Won't Intervene In U.S. Tanker Debate

PARIS - Europe must settle a dispute with the United States over the U.S. tanker plane contract without the help of the World Trade Organization, which cannot rule on trade in military equipment, the head of the WTO said April 12.

"In this case, it is military equipment and the rules of international trade do not apply," WTO secretary-general Pascal Lamy said on French television channel Canal+.

The WTO settles trade disputes between its 153 member countries, and Boeing and Airbus already have long-standing complaints against one another over state subsidies for their civil aviation projects pending.

France and Germany have accused the United States of protectionism in the bidding process for the $35 billion contract to supply the U.S. Air Force with 179 tanker planes, a competition ongoing since 2003.

European defense group EADS, owner of the French plane maker Airbus, pulled out of the contest along with its U.S. partner Northrop Grumman, complaining the terms were skewed in favor of American rival Boeing.

Airbus later signaled it was still interested in bidding, and France has pressed the United States to ensure "open" bidding for the contract.
Louis Gallois, the head of EADS, said that his company had "not taken a decision [and] we do not have a cut-off date" on bidding for the contract, which it originally won before Boeing cried foul.

"The only cut-off date is July 9, when bidding companies have to submit their offers [to the US authorities]," Gallois told LCI.
The Pentagon announced March 31 it would extend the deadline for bidding by 60 days if it received formal notification from EADS that it intended to make an offer.

"We must be convinced that we can make a competitive offer, and there are several conditions for that," Gallois said, adding that talks were still underway with U.S. authorities and possible U.S. partners for the project.

The US companies Raytheon and L-3 Communications have been mentioned in connection with the EADS bid, as well as BAE Systems.

The winner of the contract to supply 179 planes to update an aging 1950s-era Boeing fleet of tankers is expected to be declared by "early fall," a Pentagon spokesman said recently.
