Of course D-HABS is not of the German Army and will never be.

D-HABS is leased from ADAC and only used for training by the IntHubschrAusbZ.

That's a discussion that will always come back. It has no military serial, no roundel, no squadron markings, so purely civil in my opinion. No matter who flies it. But others will define it differently. Either way, it is a mishap of a German EC.135....
